Definition

Cookies are text files that are sent to and stored on your computer, smartphone or any device capable of accessing the internet. They are saved when you visit a website.

Thus, cookies are data stored in an internet user’s terminal equipment and used by the site to send information to the user’s browser, allowing this browser to send information back to the originating site (for example, a session identifier, language choice or date).

Cookies allow status information to be retained for the duration of the cookie’s validity when a browser accesses the various pages of a website or when that browser subsequently returns to that website. Cookies are useful because they allow a website to recognise the device being used by an internet user.

Only the issuer of a cookie can read or modify the information contained within it.

There are different types of cookies:

  • session cookies that disappear as soon as you leave the site;
  • persistent cookies that remain on your device until they expire or until you delete them using your browser’s features.

You are informed, during your visits to the site, that cookies may be installed on your terminal equipment.

Legal Framework

In accordance with the European “Telecom Package” directive, you must be informed and give your prior consent before cookies and trackers are installed.

In this context, you have the option to choose not to be tracked when you visit a site or use an application.

Your prior consent to the installation of cookies and trackers is valid for a maximum of 13 months.

However, in accordance with applicable regulations, certain trackers are exempt from the requirement to obtain consent.

The only exceptions to this principle are if these actions are strictly necessary for the delivery of a service expressly requested by the user.

Thus, in accordance with the recommendations of the French Data Protection Authority (CNIL), cookies that are strictly necessary for the operation of the website or whose sole purpose is to enable or facilitate electronic communication are exempt from prior consent. These include session identifier cookies, authentication cookies, load balancing session cookies and cookies for personalising your interface.

Which cookies require prior information and a request for consent?

In principle, cookies requiring prior information and a request for consent may include, but are not limited to:

  • cookies related to targeted advertising operations;
  • certain audience measurement cookies (see exemptions below);
  • social network cookies generated in particular by their sharing buttons when they collect personal data without your consent.

This requirement therefore applies to cookies issued by third parties that are classified as “persistent” in that they remain on your device until they are deleted or reach their expiry date.

As such cookies are issued by third parties, their use and placement are subject to their own privacy policies. However, the law provides that certain trackers are exempt from the requirement to obtain your consent.

The specific case of audience measurement (analytics) cookies

To be exempt from the consent requirement, audience measurement cookies must meet the following conditions:

  • you must be informed in order to be able to object to the processing (this objection must be possible from any device);
  • the data collected must not be cross-referenced with other processing operations (customer files or traffic statistics from other sites, for example);
  • the tracker placed must only be used for the production of anonymous statistics and must not allow tracking of navigation across different sites. It must not be retained beyond 13 months and must not be extended upon new visits;
  • raw traffic data associated with an identifier must also not be retained for more than 13 months;
  • the use of the IP address to geolocate you must not allow your street to be determined: only the first two octets of IPv4 addresses may be retained and possibly used for geolocation (for IPv6, only the first 6 octets may be retained).

Analytics solutions that do not meet the above conditions must be subject to obtaining your prior consent.

The use of trackers is governed by Article 32 II of Law No. 78-17 of 6 January 1978, transposing Article 5.3 of Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002, as amended by Directive 2009/136/EC.

What cookies do we use?

The cookies used on the site are session cookies and audience measurement cookies.

For audience measurement, SDTECH MICRO uses the services offered by Google LLC.

The data collected through Google Analytics cookies is processed by Google LLC. Google is certified under the EU-US Data Privacy Framework, recognised by the European Commission as ensuring an adequate level of protection for personal data (Adequacy Decision of 10 July 2023).

The Google Analytics service makes it possible to count visitors and identify how they use the site. These cookies are placed and read on the user’s terminal equipment as soon as they access a website using the “Google Analytics” service.

SDTECH MICRO also uses Microsoft Clarity, a behavioural analysis tool provided by Microsoft Corporation. This service allows visualisation of how users interact with the site (clicks, scrolling, navigation) via heat maps and anonymised session recordings. The data generated by these cookies concerns:

  • your use of the site;
  • your IP address in order to determine the city of connection.

This data is immediately anonymised after localisation and is not communicated to SDTECH MICRO.

Purposes of the cookies used

a) Session cookies

The cookies used by the company are strictly necessary for the operation of the website.

b) Audience measurement cookies

The cookies used by the company are used for the purpose of analysing site traffic and usage, and to ensure effective site maintenance, allowing smoother and more tailored use for each of you.

More specifically, the cookies used by SDTECH MICRO may enable it to:

  • Compile statistics and traffic and usage volumes for the various services offered on www.sd-tech.com;
  • Verify that the Site is functioning and opening normally;
  • Improve the Site by identifying technical errors;
  • Where applicable, remember information you may have provided when filling in a form (registration or access to your account) or relating to products, services or information. This notably prevents presenting you several times in succession with a satisfaction survey you have already completed;
  • Adapt the presentation of our website to the display preferences of your device (language used, display resolution, operating system used, etc.), where applicable, so that you do not have to enter them each time you connect.

SDTECH MICRO does not record data, nor archive or use information relating to individual users.

c) Advertising cookies

Advertising content (graphics, animations, videos, etc.) displayed in our advertising spaces may contain cookies issued by third parties: (communications consultancy, audience measurement company, targeted advertising provider, etc.), which has associated a cookie with an advertiser’s advertising content.

Cookies issued by these third parties may allow them, for the duration of validity of these cookies, to:

  • count the number of displays of advertising content distributed via our advertising spaces, identify the advertisements thus displayed, the number of users who clicked on each advertisement, enabling them to calculate the sums due as a result and to compile statistics;
  • recognise your device during its subsequent browsing on any other site or service on which these advertisers or third parties also issue cookies and, where applicable, adapt these third-party sites and services or the advertisements they display to the browsing of your device of which they may have knowledge.

d) Social network sharing cookies

Our Site offers you features allowing you to share some of the content published on the Site through social networking sites. This is particularly the case with “Share” and “Like” buttons from social networks such as “Facebook”, “Twitter”, etc.

This functionality relies on cookies and similar technologies issued and managed by the publisher of the social network concerned. These cookies and similar technologies are placed on your device, if you accept them, when you browse the Site.

SDTECH MICRO has no control over the process used by third-party applications included on the Site and by social networks to collect information relating to browsing on the Site and associated with the personal data they hold.

SDTECH MICRO therefore invites the User to consult the privacy protection policies of these third parties in order to learn about the purposes of use, particularly advertising, of the browsing information they may collect through these third-party applications. These protection policies must in particular allow them to exercise their choices with these third parties, notably by configuring the user accounts held by the User with these third parties.

Consent

The Internet user is deemed to have given their consent by clicking on the “ACCEPT” icon displayed on the information banner visible upon their first connection to the Site.

If the Internet user accepts, via their browser software, the storage of cookies on their device, the cookies integrated into the pages and content they have viewed may be temporarily stored in a dedicated space on their device. They will only be readable by their issuer.

The consent given by the Internet user is only valid for a period of thirteen (13) months from the first placement on the User’s terminal equipment, following the expression of their consent.

Personal data protection

In the context of the use of cookies as described in this document, SDTECH MICRO may process personal data concerning you, as data controller.

The data collected is essential to achieve the objectives pursued by each cookie. It is intended solely for the authorised departments of SDTECH MICRO and/or its subcontractors and/or the company issuing third-party cookies.

Personal data collected via cookies is never retained longer than necessary to achieve the purpose of the cookie, and in any case never longer than 13 months.

In accordance with the provisions of the General Data Protection Regulation, individuals have a right to enquiry, access, rectification, erasure, objection on legitimate grounds and portability with respect to all data.

The data collected is, after the death of the person, retained for the period necessary for SDTECH MICRO to comply with its legal and regulatory obligations. Upon expiry of this period, the data will be deleted.
